Rankin to Trustees 1871

The following Anderson County, South Carolina records are true to the original except for highlighting.  Taken from copies of microfilm located at the South Carolina Department of Archives and History, these are located under "Wilson N. Rankin Trustee of Sarah A. Rankin # 3075" on Roll C-1423.  -- LSS.

    Know all Men by these Presents, That we George A Rankin and James C Rankin are held and firmly bound unto John B. Orr & Thos H McCann Trustees of Sarah A Rankin in the full and just sum of Twenty Seven Hundred Dollars to be paid to the said John B. Orr and Thos H McCann,Trustees as aforesaid their certain Attorneys, Executors and Administrators, or Assigns: to which payment well and truly to be made and done. We bind our selves and each and every of our Heirs, Executors, and Administrators, jointly and severally, firmly by these presents.

    Sealed with our Seal and dated at Anderson the fourteenth day of December in the year of our Lord, one thousand eight hundred and Seventy one and in the 96th year of the Sovereignty and Independence of the United  States of America.

    The Condition of the above Obligation is such, That if the above bound George A Rankin and James C Rankin  their Heirs, Executors, and Administrators, shall and do well and truly pay or cause to be paid unto the above named John B Orr and Thomas H McCann their certain Attorney, Executors, Administrators, or Assigns, the full and just sum of Thirteen Hundred and fifty Dollars in two Equal annual installments with interest from the date hereof without fraud or further delay, then the above obligation to be void, and of none effect, or else to remain in full force and virtue.

    TO ALL WHOM THESE PRESENTS MAY CONCERN, We George A Rankin and James C Rankin of Anderson County in the State aforesaid SEND GREETING:

Whereas, We the said George A Rankin and James C Rankin in and by our certain Bond or Obligation bearing date the  day of December 1871 stand firmly held and bound unto John B. Orr and Thos H McCann in the penal sum of Twenty Seven Hundred Dollars conditioned for the payment of the full and just sum of Thirteen Hundred & fifty Dollars, in two Equal annual installments with Interest from date as in and by the said Bond and Condition thereof reference being thereunto had, will more fully appear.

NOW KNOW ALL MEN, that we the said George A Rankin and James C Rankin in consideration of the said debt and sum of money aforesaid, and for the better securing the payment thereof, to the said John B. Orr and Thos H McCann according to the condition of the said Bond, and also in consideration of  the further sum of three dollars to us the said George A Rankin and James C Rankin in hand well and truly paid by the said John B. Orr and Thos H McCann at and before the sealing and delivery of these Presents, the receipt whereof is hereby acknowledged, we have granted, bargained, sold and released, and by these Presents DO GRANT, bargain, and sell, and release unto the said John B. Orr and Thos H McCann All that tract or parcel of land containing Two Hundred and Twelve Acres, on the three & twenty mile creek boundary

lands of Thos F Rankin and others, being the tract this day conveyed by them to us  TOGETHER with all and singular the rights, members, hereditaments, and appurtenances to the said premises belonging, or in anywise incident or appertaining:

To have and to hold all and singular the premises unto the said John B Orr & Thos H McCann their heirs and assigns forever. And we do hereby bind ourselves our heirs, executors and administrators, to warrant and forever defend all and singular the said premises  unto the said John B. Orr & Thos H McCann heirs and assigns for and against our heirs, executors, administrators and assigns, & all others lawfully claiming, or to claim, the same or any part thereof.

Provided always, nevertheless, and it is the true intent and meaning of the parties to these presents, that if  we the said George A & James C Rankin do and shall well and truly pay, or cause to be paid, unto the said John B. Orr & Thos H McCann the said debt or sum of money aforesaid, with the interest  thereon, if any shall be due, according to the true intent and meaning of said Bond and condition thereunder written, then this deed of bargain and sale shall cease, determine, and be utterly null and void; otherwise it shall remain in full force and virtue.   

And it is agreed, by and between the said parties, that we the Said George A and James C Rankin are to hold and enjoy the said premises until default or payment shall be made.

    WITNESS our HandS and SealS this fourteenth day of December in the year of our Lord one thousand eight hundred and seventy One, and in the 96th year of Independence of the United States of America.

PERSONALLY APPEARED BEFORE ME  James Mullekin Notary Public M. W. Ford and made oath that he  saw the within named George A Rankin and J C Rankin sign, seal, and as their act and deed, deliver the within written Deed; and that J. M. Glenn with himself was a Subscribing witness witnessed the execution thereof
