121 State of South Carolina Pendleton District Know all men by these presents that I David Smith of the State and District aforesaid in consideration of two hundred and ten Dollars to me paid by William Orr Mercht of the State and District aforesaid have Granted bargained Sold and Released and by these presents do Grant bargain Sell and Release unto the said William Orr all the one half both Grist Mill and saw mill as they both now Stand and are Occupied by the said David Smith and William Rankin on the 23 Mile Creek with all the rights and priviledges to build improve and Occupy the same in equal copartnership from hence and for now with the said William Rankin his heirs and assigns together with all and Singular the rights Members hereditaments and appertenences to the said premises belonging or in any wise Incident as appertaining to have and to hold all and singular the premises before Mentioned unto the said William Orr his heirs and assigns forever and I do hereby bind Myself my heirs Executor and Administrators to Warrant and for ever Defend all and Singular the said primises unto the said Willim Orr his heirs and Assigns Against my self and my heirs and against every person Whomsoever Lawfully Claiming or to Claim the same or any part thereof Witness my hand and Seal this nineteenth Day of febury 1802 and of the twenty sixth year of the Independence of the United States of America

Memorandom that in the nineteenth Day of febuary in the year of our Lord one thousand Eight hundred and two before me John Wilson One of the Justices of the Quorum for the District of Pendleton Personally came Robert Pickens and being duly sworn and on oath saith that he did see David Smith Sign seal and as his act and Deed deliver the within Deed unto William Orr for the uses and purposes therein Mentioned and did also see William Forbes and Wm McMahen sign their names as Witnesses with him self to the same Sworn and Subscribed the Day and year above Written before Me John Wilson J Q

State South Carolina Pendleton District I John Wilson one of the Justices of the Quorum do hereby Certify onto all whom it May Concern that Rebecah Smith the Wife of the within named David Smith did this Day appear before Me and upon being privately and seperately Examined by me did declare that she does freely voluntarily and without any Compulsion Dread or fear of any person or persons whomsoever renounce release and forever relinquish unto the above named William Orr his heirs and Assigns all her Interest and Estate and also all her right or Claim of Dower of in or to or to all and singular the premises above Mentioned and Released Given under my hand and seal this 18th Day of March anno domini 1802 Rebecah (her mark) Smith
